January 19, 2025

These Terms of Service ("Terms") govern your use of Artometrics — the website at artometrics.com, our data reports, podcast, membership features, and related services (collectively, the "Services").

When we say "Artometrics," "we," "our," or "us," we mean the operator of the Artometrics publication. When we say "you" or "your," we mean any person or organization that accesses or uses the Services.

By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The Services

Artometrics publishes independent data-driven reports on culture, place, history, persona, and power, along with a podcast and optional paid membership. Reports are provided for informational and editorial purposes. They are not financial, legal, medical, or investment advice.

We may update, add, or remove features at any time. Material changes to these Terms will be reflected by updating the date on this page.

Accounts

Some features — including subscriber-only podcast episodes, saved reports, and billing — require an account.

You are responsible for:

  • Keeping your login credentials secure
  • All activity that occurs under your account
  • Providing accurate registration information

You may not create accounts through automated means or impersonate another person. We may suspend or terminate accounts that violate these Terms or our Ethics Statement.

Membership and payments

Paid membership is optional. Prices, billing intervals, and included features are shown on the pricing page at checkout.

By subscribing, you authorize us and our payment processor (Stripe) to charge your selected payment method on a recurring basis until you cancel. You can manage or cancel your subscription from your account page.

Refunds are handled according to the plan terms shown at purchase and applicable law. If you believe you were charged in error, contact us through the contact page.

Content and intellectual property

Artometrics reports, charts, copy, branding, podcast audio, and site design are protected by copyright and other intellectual property laws unless otherwise noted.

You may:

  • Read and share links to public reports
  • Quote brief excerpts with attribution and a link back to the original report
  • Use charts and data for personal, non-commercial reference with source credit

You may not:

  • Republish full reports or podcast episodes without permission
  • Remove source credits, methodology notes, or attribution
  • Scrape, bulk-download, or resell our content or datasets
  • Misrepresent Artometrics analysis as your own original work

Some reports reference third-party datasets and literature under their respective licenses. Those restrictions still apply.

Acceptable use

You agree not to:

  • Interfere with the security or operation of the Services
  • Attempt unauthorized access to member-only content, accounts, or infrastructure
  • Use the Services to distribute spam, malware, or unlawful material
  • Harass staff, contributors, or other users through contact or account channels

Privacy

Our collection and use of personal information is described in our Privacy Policy and Cookie Policy. Where applicable, our Data Processing Addendum governs processor relationships.

Disclaimers

The Services are provided "as is." While we work to cite sources, disclose limitations, and correct errors promptly, we do not guarantee that every report is complete, current, or free of mistakes.

Data reports reflect the datasets, assumptions, and editorial judgment available at publication time. Derived metrics and editorial indices are explained on our methodology page and within individual reports.

Limitation of liability

To the fullest extent permitted by law, Artometrics will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim related to the Services is limited to the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars if you have not paid for membership.

Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we discontinue all or part of the Services.

Upon termination of a paid account, member-only access ends according to the billing terms in effect at cancellation. Public reports remain subject to the content restrictions above.

Governing law

These Terms are governed by the laws of the United States and the state in which Artometrics operates, without regard to conflict-of-law rules.
